There would appear to be a very common misconception that people in the UK have, concerning Wills and inheritance. Dying without a Will
If you have your own property, are married or in a civil-partnership, as well as having children or any other dependants, you could potentially have no say over the distribution of your estate and assets. The distribution of your estate is then susceptible to the Intestacy Rules.
Without a Will, you are also leaving the distribution of your estate and assets liable to be contested by other family members, who you may never have considered for any inheritance.
If you don't have a Lasting Power of Attorney (LPA)
A Lasting Power of Attorney is the legal document which allows a loved one or Trustee to take care of your health and financial needs, if you have lost your mental capacity.
There are two types of LPA:
Health and Welfare - Gives your attorneys the ability to make the delicate decisions over your health care, should you not be able to make such decisions yourself but in accordance with your written wishes.
Property and Financial - This gives your attorney the authority to deal with buying or selling your property, and access to bank accounts and other investments or financial products.
A Lasting Power of Attorney enables you to appoint someone you can trust to make the right decisions on your behalf.
