Life Cover Isn’t Enough. Why you Also Need a Lasting Power of Attorney
When assessing an individual’s likelihood of serious illness or death, insurance companies consider a range of factors including lifestyle choices (whether you are overweight or a smoker), occupation, your state of health and the nature of your pastimes or hobbies. If you are a smoker or very overweight they will consider you a greater risk and charge you more. If you engage in:
· White-Water rafting
· Hot air ballooning
· Scuba diving
Or any other activities which would be identified as high risk, it is statistically more likely you will die or be seriously injured and they will, again, charge you more. It is usual for most of us now to put life cover into place to protect our loved ones but how about a Lasting Power of Attorney (LPA)?
An LPA is the only mechanism whereby in the event of a loss of mental capacity those individuals you have identified can make decisions on your behalf – whether this is with regards to your health and care or your finances and property. This protects you as well as your family – how would your spouse or partner manage if all access to finance was cut off because the state was protecting you as the vulnerable individual?
Jack Straw, former Lord Chancellor and Secretary of State for Justice said, "We all know how important it is to plan for the future. Having a Lasting Power of Attorney in place should be as common and natural as making a Will”.
Without an LPA in place, should you be unable to make your own decisions, your spouse/children will have to go to the Court of Protection for permission to make even mundane decisions. This process is hugely costly (costing thousands of pounds), bureaucratic and many of those tied to it describe it as hugely frustrating and incredibly slow. The quick, easy, cost-effective solution, is to put your LPA into place TODAY.
