Lasting Power of Attorney in Newcastle
WHY ARE LASTING POWER OF ATTORNEY ESSENTIAL?
Many people in Newcastle will automatically assume that, should they lose mental capacity, their family and loved ones will be able to control their lives. This sometimes isn't the case – unless Lasting Power of Attorney (LPAs) have been arranged.
According to the Mental Capacity Act 2005 "A person lacks the capacity if they are unable to make a decision for themselves - in relation to a specific matter at a particular time - because of an impairment of, or a disturbance in, the functioning of their mind or brain. In some cases, a person's capacity may be permanently affected, perhaps because they have some form of Dementia, learning disability or have suffered a brain injury. But in others, the person's capacity might be affected only for a temporary period, perhaps because they are confused or unconscious."
There are two different types of Lasting Power of Attorney, Financial & Property and Health & Welfare, see below for how they differ.
Without a Financial & Property LPA being in place, The Court of Protection has the power to assume control of your finances and can freeze all of your assets including joint bank accounts.
Without a Health & Welfare LPA being in place, Local Authorities and the NHS can make decisions which you may not have agreed with if you had mental capacity.
